[2] Election Commissioner Mahbub Talukdar has said the Election Commission should have the right to cancel the candidacy of a candidate, and if this right is taken away the Commission would turn out not to be a clawless tiger but merely a cat, reports rtvonline.com.
At the 69th meeting of the Election Commission, Mahbub gave note of dissent to three points in writing and sent those to the Chief Election Commissioner and three other Commissioners, reports Jago News.
[3] Mahbub said the EC Secretariate earlier sent a draft of People Representation Bill 2020 to the Law Ministry. [4] According to the Law Ministry opinion, the draft was sent by dropping 11 basic and procedural rules. The most important point, he mentioned, is that so long the Election Commission has got the right to scrap the candidacy of a candidate under section 91 of RPO of 1972 but the draft proposed to drop that provision that was incorporated in the RPO with the consent of all political
parties.
[5] Mahbub said the Rakibuddin Commission had to face a lot of criticisms when he tried to cancel that provision. He said it would be suicidal for the election commission to give up its unilateral power to scrap the candidacy of a
candidate.
