The High Court on Monday asked a Rangpur lower court judge to explain how he accepted a rape case filed against a 52-year-old man as a ‘child miscellaneous case’.
While hearing the bail petition of the accused, an HC bench comprising Justice M Eanyetur Rahim and Justice Amir Hossain asked M Rokanuzzaman, judge of Rangpur Additional Session’s Judge Court-1, to explain his stance in written within 10 days.
At the same time, the court also dismissed the bail petition of Delwar Hossain.
Court sources said Delwar allegedly raped a 15-year-old girl in Pirgachha upazila of Rangpur on October 12 last year.
Police arrested the accused on the same day after a case was filed under the Women and Children Repression Prevention Act in this connection.
Mentioning the case as a child miscellaneous case, the accused filed a bail petition with the lower court. On January 13 last, Judge Rokanuzzaman denied the bail.
Deputy Attorney General Moniruzzaman Kabir said the judge accepted the case as a child case although the accused is 52-year-old. “As a result, the accused will enjoy the facilities of the children law,” he said.
